NOTE: Police traffic duties involve two categories: Moving and Non-Moving. Non-Moving is considered things such as seat belts not being in use, use of electronic devices, etc. In short, things that are happening inside the vehicle but are still traffic related.

If you are the driver and need to use your phone, you must pull over at a safe place on the side of a highway, on an approach, or in town, find a parking place before using your cell phone.

You CANNOT for example, be at a traffic light, stop sign or in a drive thru and use your cell phone. Even if your car is in park, you still cannot legally use your cell phone as these places are considered an area where traffic is moving or expected to be moving.
