Prairie View Municipality held a Regular Meeting in the Birtle Chambers on July 14 at 9:00 a.m. Members present were Clark, Bertram, Butler, Fulcher, Howard, Salmon, Oliver, Wilson; staff present were Interim CAO Epp and Administrative Assistant Bonner.

  • Councillor Bertram declared an conflict of interest in Item 4.1 and left the chambers during the hearing.
  • Council adjourned the regular meeting to meet again following the Conditional Use and Variation Order Hearing.
  • Public Hearing for Conditional Use Application CU-02-15-PV (Sandstrom) and Variation Order Application VO-02-15-PV (Sandstrom). In attendance was L. Clark, M. Butler, C. Bertram, M. Fulcher, D. Howard, D. Oliver, L. Salmon, R. Wilson, Interim CAO Epp and Administrative Assistant Bonner. Public attendance included J. Corr, D. Gies, K. Salmon, K. Fulton, K. Armitage, M. Donald; applicant present: J. Sandstrom.
  • Reeve Clark called the hearing to order at 9:05 a.m. J. Corr requested that the meeting be recorded. Procedure By-law 2015-04 does not allow for audio/video recording of meetings in the council chambers.
  • The CAO advised the purpose of the hearing was to hear Conditional Use Application No. CU-02-15-PV for the establishment of an "Aircraft Landing Area" in the "AG" Agricultural General Zone on the site described as the former Road Allowance between the northerly ¼ sections bordering the road allowance: SW 17-16-27WPM and the SE 17-16-27WPM and the northerly ¼ sections bordering the road allowance of SW 17-16-27 and SW 17-16-27 WPM, and Variation Order Application VO- 02-15-PV from the landowner Prairie View Municipality and Applicant Janet Sandstrom to vary the established requirement for a minimum site width of an aircraft landing area in the “AG” Agricultural General Zone from 200 feet to 99 feet.
  • CAO advised the hearing was advertised and notices were placed on the Municipal Bulletin Board on June 30, 2015 and notices were mailed to adjacent landowners by Mid-West Planning District.

Applicant presentation: J. Sandstrom spoke to the Conditional Use and Variation Order applications. Questions to Sandstrom and responses are as follows:

Corr: Could this be serviced out of an established airport?

Sandstrom: They do fly out of some established airports. Shorter distance - more time and cost effective.

Corr: Was there approval from Transport Canada for a public air strip?

Chairperson Clark requested that questions be held until Council has heard public presentations.

Public Presentations: Corr and Kinwest 2008 Energy Inc presented by Mr. Corr. Gies: Why Province and Federal Government established the 200’ requirement for airstrips   - was consideration given to using one quarter and making a diagonal strip on private land?

Sandstrom: Other locations had been considered, one of the factors was the location of hydro lines, etc.

Gies: Who owns road allowances?

CAO: Road are a municipal responsibility, Her Majesty the Queen owns the roads Gies and J. Corr requested a copy of the lease agreement.

Sandstrom: Intention is for strip to be a private strip but Transport Canada rules would be followed.

Corr: Why is municipality only allowing the applicants to use the runway?

Wilson: Municipality is not bearing much cost for runway. Prairie Dusters who will be benefiting from runway are bearing the costs.

Corr: Safe fuel storage and delivery

Sandstrom: Will follow safety regulations and aviation rules

 Gies: Would Road 568 be use  - signed as “Local Traffic Only - who would be liable for damage. Are there penalties for proceeding with work - minutes for public hearing on website - issue of burrowing owls brought up at public hearing.

 Salmon: Keeping public off runway - concern with vehicles or quads leaving ruts on runway.

 Sandstrom response: if necessary could place gate at each road - signage could be placed  - Fulton: Policing of an airstrip - could turn into a public airstrip.

 Council having completed its duties at the Conditional Use and Variation Order Hearing (Sandstrom) now closes the hearing.

  • Ms. Brown attended Asessippi Parkland Settlement Services and provided council with information on what Settlement Services does in the Municipality. A request was made for a letter of support to include in the organization’s applications for future funding from the federal government.
  • A reply will be given on the offer to purchase of land sent by Richard Grabauskas, advising the Municipality is aware he is not interested in the property if there is any condition requiring development within a certain time period.
  • The establishment of a two family dwelling on the property owned by Decker Holding Company, as outlined in the letter from Mid- West Planning District dated July 8, 2015, was approved.
  • Applicant, Janet Sandstrom, has applied to the Mid-West Planning District for a Conditional Use Permit to provide for the establishment of an “Aircraft Landing Area” in the “AG” Agricultural General Zone on the site described as the former Road Allowance between the northerly ¼ sections bordering the road allowance: SW 17-16-27WPM and the SE 17-16-27WPM and the northerly 1/4 Sections bordering the road allowance of SW 17-16-27WPM and SW 17- 16-27 WPM. According to Zoning By-law No 07/02 (AG) Agricultural General Zone Table 8.1, a non-farm dwelling requires a Conditional Use Permit. After careful consideration of the application and Public Hearing the Council of the Prairie View Municipality approved Conditional Use Permit #CU-02-15-PV. The applicant is responsible to obtain all permits required. Landowner Prairie View Municipality, and applicant Janet Sandstrom, of the property legally described as the lands between Section 17-16-27 WPM and Section 08-16-27 WPM in the Prairie View Municipality, has applied to the Council of the Prairie View Municipality to vary the application of the RM of Birtle Zoning By-law No. 2010-02, as amended, under Part 7 Section 7.21 to 7.28, Part 4 Table 4.1, in order to vary the established requirement, in accordance with the following description: being from the minimum site width of 200 feet required for the establishment of aircraft landing area in the “AG” Agricultural General Zone to be varied to 99’ for the purpose of the creation of a private aircraft landing strip. After careful consideration of the application and any representations made for or against it, the Council of the Prairie View Municipality approved the variation.
  • The establishment of a second dwelling on the property owned by Les and Marlene Bryant in the SW 24-14-27W, as outlined in the letter from Mid-West Planning District dated June 18, 2015, was approved.
  • The attendance of two representatives of council at the Prairie Mountain Health Physician Recruitment and Retention Symposium on August 19 was approved.
  • Payment of the annual Manitoba Regional Recyclers Association membership fee was approved.
  • The MTS Municipal Rights-of-Way application, for work in the municipal road allowance on the north side of PTH #24 between the SW 33-13-26WPM and NW 28-13-26WPM, as outlined in the June 17, 2015 application, was approved.
  • Council of the Prairie View Municipality will provide a letter of support to the Asessippi Parkland Settlement Services, as requested.
  • The signing of the Multi-Year Funding Agreement for the operation of the Valley Recreation District was approved.
  • Council went into an In-Camera Session to discuss legal issues. Council adjourned their In-Camera Session and resumed the former order of business.
  • The quotation for sidewalks within the LUD of Miniota from Roger Branum Construction dated June 29, 2015, was accepted.
  • Only one Council meeting will be held for July and August 2015. The meetings will be held July 14 in Birtle Chambers and August 18 at 1:00 p.m. in Miniota Chambers.
  • Credit cards may not be used for payment to the Municipality effective July 15, 2015.
  • The attendance of two council representatives at the Wallace-Woodworth Municipal Office Grand Opening was approved.
  • Payment of the permit fee to Manitoba Highway Traffic Board, for the relocation of the Welcome to Foxwarren NHL sign, in the amount of $50, was approved.
  • Policy GG-005 Tendering and Procurement was adopted.
  • The following accounts be hereby approved for payment: General Disbursements amounting to $253,432.58 by cheques numbering 382 to 450, including other payments and payroll in the amount of $76,104.46 numbering 349 to 399.
  • Council went into an In-Camera Session to discuss legal and personnel issues. Council adjourned their In-Camera Session and resumed the former order of business.
